A federal judge has ruled that a Farmers Branch ordinance banning illegal immigrants from renting apartments is unconstitutional.
U.S. District Judge Jane J. Boyle of Dallas ruled Wednesday that the ordinance was an attempt to enforce U.S. immigration laws, something only the federal government can do.
"Ordinance 2952 is a regulation of immigration and is preempted by the Supremacy Clause of the United States Constitution because the authority to regulate immigration is exclusively a federal power," she wrote.
Boyle said in her ruling that the measure uses federal immigration classifications in ways that aren't authorized or contemplated by federal law."As a result, the ordinance creates and additional restriction on alien residence in the city," she wrote.
The judge also said in her ruling that Ordinance 2952 "directly and substantially" regulates the residence of ((ILLEGAL -- Jemison)) immigrants in Farmers Branch, which interferes with the uniform enforcement of federal immigration laws. ((by uniform, of course, they mean nobody doing anything about the problem -- Jemison))
What a piece of judicial crap. It'd be almost palatable if the Feds were actually TRYING to do something to restrict the tidal wave of illegal migration. After all, the only reason localities are taking time to enact such ordinances is that this invasion (let's call it what it is, please) has real consequences for those of us who live outside the alternate reality known as D.C.
I'm sure someone reading this will dismiss it as racist ranting. Let me be blunt, one more time: I welcome ANYONE who comes to America by the rules, planning to contribute at least as much as they expect from society. But those who successfully enter illegally are not entitled to set up shop here as though they had followed the (very lenient to begin with) entry procedures to join us. Wearing a robe and pounding a gavel when you say they do doesn't make it so.
"When any government becomes destructive of these ends..." Look to your States. D.C. is irredeemable, as are all the Federal tentacles that emanate from it.
